1. Overview

1.1 Who We Are

Wish and Give, Incorporated (hereinafter “Wish and Give”) operates a ticketing and invitation platform dedicated to donating to local causes across Canada. Through the Wish and Give platform, Wish and Give enables people across Canada to create invitations, sell tickets and register for events while donating to local causes (collectively, the “Services”). This Privacy Policy applies to the collection, use and disclosure of personal information by Wish and Give.

1.2 The Services; Responsible Party

Wish and Give provides the Services through Wish and Give websites and domains, including www.wishandgive.ca, www.wishandgive.com, wishandgiveparty.ca, wishandgiveparty.com, and any other webpages, subdomains, variants that link or refer to this Privacy Policy (collectively, the “Website”). Wish and Give is an Ontario corporation with its principal place of business at PO Box 99900 TJ 358 890, RPO Bloor West, Toronto, ON, M6S 0A3, Canada.

1.3 Users

In providing its Services, Wish and Give allows for registered users who are event hosts, planners, parents and charitable organizations (“Hosts”) to create an invitation, event tickets, donation pages and other webpages related to their invitation or events. Hosts can promote those pages and events to visitors or browsers of the Services, can sell or issue tickets and registrations, and can solicit donations and group gifts related to their event. Users who wish to make purchases, registrations or donations from or to such invitations and events (including to free events) (“Guests”). We refer to Hosts, Guests and other visitors and browsers of the Services collectively as “Users” or “you.”

2. Our Privacy Statement

2.1 Application

This Privacy Policy sets out our policy with respect to information that can be associated with or which relates to a person and/or could be used to identify a person (“Personal Data”) that is collected from Users on or through the Services. "Non-Personal Data" as used in this Privacy Policy is therefore any information that does not relate to a person and/or cannot be used to identify a person.

Like most website operators, we collect non-personally-identifying information (“Non-Personal Data”) of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor/customer request through Cookies, Pixel Tags, Local Shared Objects, Web Storage and other similar technologies.

A cookie is a string of information that a website stores on a visitor/customer’s computer, and that the visitor/customer’s browser provides to the website each time the visitor/customer returns. The purpose in collecting non-personally identifying information such as cookies is to help us identify and track visitors, their usage of the Website, their Website access preferences, and to better understand how visitors use the Website. From time to time, we may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of this Website. Our visitors/customers who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Website, with the drawback that certain features of the Website may not function properly without the cookies. The limitations and requirements in this Privacy Policy on our collection, use, disclosure, transfer and storage/retention of Personal Data do not apply to Non-Personal Data.

We will also collect potentially personally-identifying information like Internet Protocol (IP) addresses. However, Wish and Give does not use such information to identify its visitors/customers and does not disclose such information, other than under the same circumstances that it uses and discloses Personal Data, as described in this Privacy Policy.

3. Personal Data Collection

When you use or interact with us through the Services, we may collect Personal Data, as described below:

3.1 All Users

Information you provide to us: For all Users we collect Personal Data when you voluntarily provide such information through the Website, such as when you register on the Website for access to the Services, contact us with inquiries, respond to one of our surveys or browse or use certain parts of the Website or access the Services. The Personal Data we may collect includes without limitation your name, address, phone number, date of birth, email address and other information that enables Users to be personally identified.

When you register for the Services or otherwise submit Personal Data to us, we may associate other Non-Personal Data (including Non-Personal Data we collect from third parties) with your Personal Data. At such instance, we will treat any such combined data as Personal Data until such time as it can no longer be associated with you or used to identify you.

3.2 Hosts

As a Host we will collect additional Personal Data from you.

Information you provide to us: In some cases, we may collect your credit card information for payment purposes, some of which may constitute Personal Data. In addition, if you use our payment processing services, we will collect financial information from you (e.g., your bank account information or an address to send cheques) as necessary to facilitate payments and information required for tax purposes (e.g., your taxpayer identification number).

Information we obtain from other sources: We may also collect or receive Personal Data from third party sources, such as third party websites, your bank, our payment processing partners and credit reporting agencies.

3.3 Guests

As a Guest we will collect additional Personal Data from you.

Information you provide to us: If you register for a paid event, we will collect necessary financial information from you, some of which may constitute Personal Data. In addition, Hosts can set up event registration pages to collect virtually any information from Guests in connection with registration for a Host’s event listed on the Website. If a guest voluntarily provides that information in connection with registration for an event or invitation, it will be available to us and will be held by us in accordance with this Privacy Policy. In addition, such information will be delivered to the Host of the applicable event in accordance with “How We Disclose and Transfer Your Personal Data: Hosts” below.

Information we obtain from other sources: We may also collect or receive Personal Data from third party sources, such as Hosts, other guests, social media or other third party integrations, your credit card issuing bank, our payment processing partners or other third parties.

4. Use of Personal Data

We collect and use the Personal Data in a manner that is consistent with this Privacy Policy. Whenever we collect your Personal Data, we will identify the purposes for which we will use that information and we will obtain your consent to such use. We may use the Personal Data as follows: sending you information and communications; responding to email inquiries and other requests, processing transactions, optimizing your experience with our Services and on our Website, and for internal purposes, including, analyzing and managing our business and improving our Services and promotion efforts.

4.1 Host Emails

We allow Hosts to use our email tools to contact Guests for their current and past events, so you may receive emails from our system that originate with such Hosts. If you have registered for an event on the Website, your email is available to that Host. However, Hosts may also import the emails they have from external sources and send communications through the Services to those emails and we will deliver those communications to those emails.

4.2 Other Purposes

If we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time the Personal Data is collected.

4.3 User Profile

On the Website, you may be able to become a Registered User and create your User profile. A User profile is stored information that we keep on individual Users that details their viewing preferences, activities and interactions. When you decide to become a Registered User, we ask for some basic contact information, such as a username and your postal code and email address. If you attend events for which payment is required, you may enter additional information which also may be stored as part of your User profile. You may review and edit your User profile information, or delete your User profile, at any time.

You can browse the Services without providing any Personal Data (other than Non-Personal Data to the extent it is considered Personal Data under applicable laws) or with limiting the Personal Data you provide. If you choose not to provide any Personal Data or limit the Personal Data you provide, you may not be able to use certain functionality of the Services. For instance, in order to open an account, or buy or sell tickets, your name and email address will be required.

When a Registered User choses to host a party, a base profile of the party is created by Wish and Give. Wish and Give collects any personal information that a Registered User may voluntarily include as part of the profile or the materials that the Registered User posts to the Site.

The personal information collected is used to administer and operate the Website, display User profiles and for any other disclosed purposes or other purposes reasonably ancillary to those purposes.

4.4 Donation Program

Wish and Give may collect personal information relating to Registered Users who choose to participate in the Services offered by Wish and Give via the Website. This personal information includes but is not limited to that which is necessary to perform the activity and is disclosed as being collected for that purpose and any other personal information that can reasonably be considered ancillary to that purpose. This information is used by Wish and Give for the purpose of operating and administering the Website. Wish and Give aggregates and depersonalizes this information.

4.5 Donations

The processing of payments and gifts made through Wish and Give’s donation program entails the collection of personal information necessary for that purpose. Making donation arrangements with the chosen charity and/or non-profit and responding to inquiries about payments and gifts also entail the collection of personal information, as well as purposes considered incidental to the aforementioned purposes.

PLEASE NOTE: When Wish and Give provides donor information to a charity or non-profit for the purpose of possibly another acknowledgement of the donation, Wish and Give informs the charity or non-profit that the consent to use that information that Wish and Give has obtained from the donor may only be relied upon by the charity or non-profit for those activities. However, please be aware that once the donor information is provided to the charity or non-profit, the charity’s or non-profit’s privacy policy is the privacy policy that applies, not this one.

5. How We Disclose and Transfer Your Personal Data

5.1 No Sale

Generally, we do not disclose your Personal Data and, where we do, we will identify to whom and for what purposes the disclosure will be made, and will obtain your consent to such disclosure. We will not sell your Personal Data to third parties, including third party advertisers. There are, however, certain circumstances in which we may disclose, transfer or share your Personal Data with certain third parties without further notice to you, as set forth below.

5.2 Business Transfers

In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets. You acknowledge and agree that any successor to or acquirer of Wish and Give (or its assets) will continue to have the right to use your Personal Data and other information in accordance with the terms of this Privacy Policy.

5.3 Parent Companies, Subsidiaries and Affiliates

We may also share your Personal Data with our parent companies, subsidiaries and/or affiliates for purposes consistent with this Privacy Policy. Our parent companies, subsidiaries and affiliates will be bound to maintain that Personal Data in accordance with this Privacy Policy.

5.4 Agents, Consultants and Service Providers

We may share your Personal Data with our contractors and service providers who process Personal Data on behalf of Wish and Give to perform certain business-related functions. These companies include our marketing agencies, database service providers, backup and disaster recovery service providers, email service providers and others. When we engage another company to perform such functions, we may provide them with information, including Personal Data, in connection with their performance of such functions.

5.5 Hosts

In some instances, a Host may appoint a third party, which may or may not be affiliated with the Host, to create an invitation event or fundraising page on its behalf ("Third Party Organizers"). In that case, we may provide your Personal Data associated with the event to both the Host, and its appointed Third Party Organizer that created the invitation, event or fundraising page. You agree that we are not responsible for the actions of these Hosts, or their Third Party Organizers, with respect to your Personal Data. It is important that you review the applicable policies of the Hosts, and if applicable and available, their appointed Third Party Hosts, of an invitation or event (and the related fundraising page, if applicable) before providing Personal Data or other information in connection with that event or related fundraising page.

5.6 Facebook and Other Third Party Connections

You can connect your Wish and Give account to your accounts on third party services like Facebook, in which case we may collect, use, disclose, transfer and store/retain information relating to your account with such third party services in accordance with this Privacy Policy. For example, if you connect with Facebook, we store your Facebook ID, first name, last name, email, location, friends list and profile picture and use them to connect with your Facebook account to provide certain functionality on the Services, like recommending events that your Facebook friends are interested in and sharing the events you are interested in, or attending, with certain groups of people like your Facebook friends.

5.7 Legal Requirements

We may disclose your Personal Data if required to do so by law.

6. How We Store Your Personal Data

We may store Personal Data itself or such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. We take what we believe to be reasonable steps to protect the Personal Data collected via the Services from loss, misuse, unauthorized use, access, inadvertent disclosure, alteration and destruction. However, no network, server, database or Internet or e-mail transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us electronically. Please keep this in mind when disclosing any Personal Data.

7. How You Can Access, Update, Correct or Delete Your Personal Data

You can request access to some of your Personal Data being stored by us. You can also ask us to correct, update or delete any inaccurate Personal Data that we process about them.

8. How Long We Retain Your Personal Data

We may retain your Personal Data as long as you are registered to use the Services. You may close your account by contacting us at info@wishandgive.ca. However, we may retain Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes.

9. Exclusions

9.1 Personal Data Provided to Others

This Privacy Policy does not apply to any Personal Data that you provide to another User or visitor through the Services or through any other means, including to Organizers on event pages or information posted by you to any public areas of the Services.

9.2 Third Party Links

This Privacy Policy applies only to the Services including those provided through the Website. The Website may contain links to other websites not operated or controlled by us (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that we endorse or have reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

9.3 Aggregated Personal Data

In an ongoing effort to better understand and serve the users, we often conduct research on our customer demographics, interests and behavior based on Personal Data and other information that we have collected. This research may be compiled and analyzed on an aggregate basis and this aggregate information does not identify you personally and we therefore consider and treat this data as Non-Personal Data.

10. Children

We do not knowingly collect Personal Data from children under the age of thirteen (13). If you are under the age of thirteen (13), please do not submit any Personal Data through the Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through the Services without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to us through the Services, please contact us info@wishandgive.ca and we will endeavor to delete that information from our databases.

11. Modifications

This Privacy Policy may be modified from time to time at our sole discretion. We will notify you of any changes by posting a new or modified Policy on our website. By continuing to use our website after those changes become effective, you agree to be bound by the revised Privacy Policy.
